Introduction
By visiting, viewing or ordering from our website you agree to acknowledge and be bound by the Terms and Conditions outlined in this agreement.
This Agreement outlines the trading Terms and Conditions bound to all Allvolts Power Solutions transactions incorporating but not limited to online, fax, phone and email ordering. Furthermore, this agreement outlines specific terms of use applicable to all aspects of our website.
The words we, us, our, Allvolts Power Solutions mean Allvolts Power Solutions of Blackman Street, Broome, West Australia 6725. The words “you” and “your” refer to registered users, customers, resellers, associates, suppliers or general public visitors to our Web Site.
We may amend this Agreement at any time in our discretion by posting the amended terms on our Site. Any amendments to this document will be posted in the online News facility and welcome page. Except as stated below, all amended terms shall automatically be effective immediately after they are posted in the online News facility. This Agreement may not be otherwise amended except through a written request from you (signed) and agreed by us (signed). This agreement is effective on 05/05/2011.

1. Governing Law
a. The Terms and Conditions of this agreement are governed by the applicable statutory rules and regulations enforced by the Federal Government of Australia and the applicable State Government of the user purchasing the goods.

2. Intended Use
a. All material including but not limited to text, images, multimedia, advertisements and downloadable content is published by us and made available to worldwide audiences. If you access this website outside of Australia, you do so at your our risk and you must comply with the rules and regulations enforced by your respective jurisdiction.
b. You agree differing terms and conditions exist between local (Australian) and international customers.
c. The general public of all ages may view all publicly available material and only copy it for personal use. You may only use material for commercial purposes when you have prior written consent from Allvolts Power Solutions.
d. Registered users may be but not limited to general public, employees or representatives of companies, associations, governments or any other corporate entity.

3. Disclaimer and Limitation of Liability
a. All material on our website is provided to you "as is" and "as available". We do not warrant or guarantee the accuracy, adequacy or completeness of this material, and expressly disclaim liability for mistakes, misleading or absent information.
b. To the maximum extent permissible by law and unless otherwise specified, we do not warrant, guarantee or make any representations and warranties of any kind, whether express, implied or statutory.
c. Whilst we promise to actively combat malicious activities, we do not warrant, guarantee or make any representations our website will be safe from such behaviour including but not limited to viruses, hackers or denial of service attacks. Furthermore, we do not warrant, guarantee or make any representations that our website will be fully accessible at all times and disclaim any loss or damages as a result of it being unavailable.
d. To the maximum extent permitted by law, we disclaim liability for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or misdirected orders, lost profits, lost registrations, lost goodwill, or lost or stolen programs or other data, however caused and under any theory of liability arising out of or in connection with (1) use of this site, or the inability to use this site by any party; or (2) any failure or performance, error, omission, interruption, defect, delay in operation or transmission; or (3) line or system failure or the introduction of a computer virus, or other technical sabotage, even if we or our employees or representatives are advised of the possibility or likelihood of such damages, losses or expenses.

4. Methods of Ordering
a. Internet
Ordering over the Internet enables customers to access real time pricing and information of our entire product range, it also allows you to view order history, create regularly ordered product templates and many other features to save time and effort.
i. All online orders are treated as an express intention to purchase the nominated goods (Purchase Order) for the agreed online
prices.
ii. You accept that other than Freight on Board (FOB) all other freight charges will not be included with your online purchase order.
iii. See Terms and Conditions of Delivery below.
We reserve the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.
b. By Phone and Email
Our friendly instore staff are ready to take orders and enquries from:
9am-4.30pm Australian Western Standard Time Monday to Friday.

All phone or email orders are treated as an express intention to purchase the nominated goods (Purchase Order) for a quoted price which may differ from online pricing.

5. Pricing
a. Unless otherwise specified, all prices on our website are quoted in Australian Dollars (AUD).
b. Listed prices are displayed including GST or other taxes where applicable.
c. All prices are subject to changes without prior notice.
d. For International customers Australian Goods & Services Tax (GST) will not be charged. This will be displayed on Checkout page.

6. Order Process
a. Unless previously quoted, you accept that any extra freight charges will be added to your order.
b. In most cases, orders that do not contain out of stock items will be processed and dispatched same day unless otherwise advised. With out of stock items, orders placed during recognized Public Holidays or extreme weather conditions eg. Cyclones, Bushfires please expect a longer dispatch time.
c. Please call us on (08) 9193 7799 if you have not received your order within 14 working days of placing your order or if you have any concerns at all.

7. Methods of Payment
a. For ordering online we accept the following methods of payment:
- Secure credit card transactions with Dialect using Secure Socket Layer technology for VISA & Master Card
- PayPal
A payment is considered complete when the funds have been cleared.
b.For offline payments we accept the following methods of payment:
- Over the phone credit card payment via VISA & Master Card
- Direct Deposit
A payment is considered complete when the funds have been cleared.
c. On account. We only accept payment on account if you are a regular customer of Allvolts Power Solutions. All account customers must fill out a credit application form prior to picking this option.

8. Delivery
a. Australia : All Orders will be sent via Australia Post who will provide via an email, a link and tracking number, or courier for larger items.
b.International : All Orders will be sent via Australia Post who will provide via an email, a link and tracking number. For some countries due to their postal systems or mail couriers the tracking number will only display tracking till departure from Australia.
c. Final Delivery : All orders both domestic and international will only be delivered to a business or residential address and may require a signature upon receipt. 
Delivery time as stated on our website is for "normal business days" and is only an approximate.
Should any customer consider that their order has not been delivered, they must contact Allvolts Power Solutions within 28 days of dispatch.
Allvolts Power Solutions will launch an immmediate investigation with Australia Post and as per their T&C s, due to some International postal services, it can take a maxmium of 30 days for a response. With Australian customers the time frame is generally 14 days.
Once Australia Post deems any order to be delivered this is final and without recourse.
d. Lost orders : Should any customer consider that they have not received their order with the possibillity of it being lost, they must contact Allvolts Power Solutions within 28 days of dispatch.
Allvolts Power Solutions will launch an immmediate investigation with Australia Post and as per their T&C s, due to some International postal services, it can take a maxmium of 30 days for a response. With Australian customers the time frame is generally 14 days.
Once Australia Post deems any order to be lost and assumes fault, Allvolts will send a replacement order including freight at their cost.
Alternatively, at this juncture should any customer wish to have a refund instead of having a replacement order sent, Allvolts will refund the customer for the order excluding freight costs.
Due to Australian Consumer Law all refunds will be issued via the original "method of payment" without exception.
e. Damaged or Missing item/s in Transit : Prior to opening any packaging, please report any damaged parcels via phone call (Australian customers) or email (International customers) to Allvolts immediately. Any packaging must be retained by the customer and images are to be taken and sent via email to orders@allvolts.com.au with full details of original order. If any item/s are then found to be damaged and are required to be returned, Allvolts will provide details and return postage at their cost. Once Allvolts has received notification or proof of "lodgement of return" of damaged item/s, Allvolts Power Solutions will replace, at their cost, only the item/s. This also applies to any missing items. The cost of freight for the shipping of replacement items is to be at the customers expense.
f. Own courier: If you choose to use your own courier, please note that you are liable for all charges imposed by your courier.
We will not be responsible for loss or damage to the goods whilst in transit.
We will simply liaise with your courier regarding pick-up of the order from our warehouse. Once the goods have been picked up by your courier, we will have no further responsibility for their loss or damage whilst in transit.

9. Returns
a. All Returns must be notified in writing by email to orders@allvolts.com.au with full order details within 7 business days of receipt of goods.
b. Incorrectly ordered and/or unwanted goods incur a 20% Re-stocking fee. Should a Customer wish to have the correct item/s resent ; 
a new online order must be placed
the incorrectly ordered item/s are to be returned at the Customers expense
once item/s are received in saleable condition, Allvolts will refund the customer for the item/s only but will waive the 20% restocking fee
c. 3rd Party fees will not be refunded eg. PayPal fees, freight etc.
d. The buyer accepts liabillity for all freight costs incured in the case of "Incorrectly" ordered or "unwanted" goods.
e. A Copy of the relevant Web Order must be included with any item/s returned.
f. Due to Australian Consumer Law all refunds will be issued via the original "method of payment" without exception.
